The Ministry of Environment and Forestry does not recommend conventional land in Simalungun


Jakarta, VIVA – Agung Pambudi from the Department of Lease Disputes and Customary Forests of the Ministry of Environment and Forestry (KLHK) of the Republic of Indonesia, emphasized that there is no decree that it is customary land in the Simalungun area in North Sumatra. Because, according to this provision, there should be a regional regulation (Perda) on normal land in this area.

“With regard to the issue of customary lands in Simalungun Province, including the recognition of a group of customary lands in Sihapora and Parmonangon, the Office of the Ministry of Environment and Forestry has not yet recommended or designated them as customary lands,” Agung said in a statement on Friday, September 20, 2024.

He said the forest is on the legal territory of indigenous peoples. However, he continued, customary forests or customary lands must have rules or regulations, including a study involving all stakeholders in the long stages of determining customary lands based on studies by the Ministry of Environment and Forests and based on the Zoning Regulations (Perda).

“However, there is still no zoning regulation for customary lands in Simalungun province,” Agung said.

Meanwhile, DPP/Presidium of Traditional Stakeholders and Scholars of Simalungun (PACS)/Partuha Maujana Simalungun (PMS) Chairman General Sarmedi Purba also stressed that there are no customary lands in the Simalungun area.

According to him, the conflict arising from unilateral claims or recognition by a group of residents on behalf of indigenous communities and traditional lands in the Simalungun administrative region is purely a criminal case.
